1. Scope of the terms

The following general terms and conditions apply to all contractual relationships between Deja Vu Museum GmbH and its customers.

Any general terms and conditions of the customer that deviate from the following provisions are expressly rejected. By placing an order, the customer acknowledges the GTC in their current version as exclusively applicable to the contractual relationship.

2. Products

Deja Vu Museum GmbH offers tickets and vouchers through the museum box office, the visitor service, and the online ticket shop. The purchase of a ticket entitles the holder to a one-time entry to the Deja Vu Museum. Upon leaving the Deja Vu Museum, the ticket becomes invalid.

For tickets booked online, a booking limit applies per booking session.

From the moment of receiving the ticket, the customer is responsible for it in case of loss, theft, or misuse. No refund will be issued by Deja Vu Museum GmbH.

3. Conclusion of the contract

Purchase of tickets via the Internet
The range of goods on the Deja Vu Museum GmbH website does not constitute a binding offer by the museum to conclude a purchase contract. By placing an order, the customer is merely invited to submit an offer through the presentation of the goods. The customer has no entitlement to acceptance of the offer.

Online ticket purchase
When purchasing tickets online, the customer is directed to a reservation portal of Deja Vu Museum GmbH by clicking the “Buy Tickets” or “Online Tickets” button. After selecting the date, number of tickets, desired time slot, and ticket type (adult or reduced), the customer then clicks the “Add to Cart” button. A cart overview with the selected tickets is displayed. By clicking the “Continue as Guest” button, a new page appears where the customer must enter their personal information (last name, first name, email address, postal code, and country). By clicking the “Order and Buy” button, the customer is taken to the page to enter their preferred payment method and complete the purchase.

The order can only be completed if the customer confirms that they have read and accepted the privacy policy, the GTC, and the cancellation policy. The customer must also declare that they explicitly request Deja Vu Museum GmbH to begin processing the order before the end of the cancellation period and acknowledge that by doing so, they forfeit their right of withdrawal.

Group tickets and reservations for the conference room
a) For group bookings made by phone through the Deja Vu Museum visitor service, the customer confirms the booking by providing their personal details. The contract is only concluded upon sending the booking confirmation via email or post. From that point, the booking becomes binding. Cancellation of individual tickets from the group is not possible. No liability is assumed for the accuracy of the information provided by the customer over the phone.

b) Reservations for the conference room become binding through two corresponding declarations of intent. Deja Vu Museum GmbH is entitled to request advance payment from the customer. If an advance payment is required, the contract is only concluded upon receipt of the advance payment by Deja Vu Museum GmbH.

Deja Vu Museum GmbH reserves the right to terminate the rental agreement without notice if the agreed advance payment is not received within the period specified in the contract.

Option dates are binding for both parties to the contract. Deja Vu Museum GmbH reserves the right to rent out the reserved room to others after the agreed period has expired, without any further notification to the customer.

4. Prices and Payment

4.1. Our prices can be found in the current price list or in the webshop for the respective products. The stated prices include the statutory value-added tax.

4.2. For contracts regarding catering services or events, invoices are payable on site immediately from the invoice date without any deduction.

4.3. For bookings made by phone, payment is made in cash or by card directly at the ticket counter or in advance, with an invoice sent to the customer. When purchasing tickets at the Deja Vu Museum ticket counter, payment can be made in cash, by debit card, credit card, or with a voucher. For online ticket purchases, only the payment methods “Credit Card” (Mastercard, Visa), “GiroPay,” and “PayPal” are accepted, which are displayed to the customer during the ordering process.

4.4. Purchased tickets for fixed times cannot be exchanged or refunded. Exceptions are at the sole discretion of the Deja Vu Museum. If entry to the museum is denied by management for unspecified reasons, the purchase price will be refunded upon return of the ticket.

4.5. Commercial resale of admission tickets to third parties requires prior consent from Deja Vu Museum GmbH. Otherwise, Deja Vu Museum reserves the right to deny entry and not refund the ticket. The ticket then becomes invalid.

4.6. Vouchers expire after 2 years in accordance with legal regulations.

4.7. The ticket holder is not entitled to a specific scope, duration, or content of the exhibition at the time of purchase, but only on the day of museum entry. The scope, duration, and content of the exhibition are subject to constant change and are at the discretion of Deja Vu Museum GmbH.

5. Shipping

Tickets purchased online are provided to the customer as print@home tickets via email. After successfully completing the payment process, the customer receives their ticket in PDF format by email. The ticket can be printed by the customer or shown on their mobile phone. Tickets are not sent by post.

6. Cancellation Policy

According to § 312g para. 2 no. 9 BGB, the right of withdrawal does not apply to contracts for the provision of services related to leisure activities if the contract specifies performance for a specific date or period. Accordingly, there is no right of withdrawal for the sale of tickets for entry to the Deja Vu Museum and for events on a fixed date. Every ticket order and event booking is therefore binding, and payment for the ordered services is mandatory.

Right of withdrawal for goods from the Deja Vu Museum GmbH shop

You have the right to withdraw from your purchase contract within fourteen days without providing any reason.

For service contracts, the withdrawal period is fourteen days from the conclusion of the contract. For purchase contracts, the withdrawal period begins on the day you or a third party appointed by you, who is not the carrier, take possession of the goods.

To exercise your right of withdrawal, you must inform us of your decision to withdraw from this contract by means of a clear statement (e.g., a letter sent by post or email):

To meet the withdrawal deadline, it is sufficient for you to inform us of your exercise of the right of withdrawal before the withdrawal period expires.

Result of the cancellation

If you withdraw from the purchase contract, we will refund all payments received from you, including delivery costs, except for any additional costs resulting from your choice of a delivery method other than the least expensive standard delivery offered by us. This refund will be made without undue delay and no later than fourteen days from the day we receive your notice of withdrawal. We will use the same payment method you used for the original transaction unless expressly agreed otherwise with you. In no case will you incur any fees for this refund. For online ticket returns at the customer’s request, PayPal charges a fee for the refund process.

Deja Vu Museum GmbH may refuse the refund until it has received the goods back or until it has received proof from the buyer that the goods have been sent back, whichever occurs first.

The buyer must return or hand over the goods to Deja Vu Museum GmbH immediately and no later than fourteen days from the day the withdrawal notice is received by Deja Vu Museum GmbH. The deadline is met if the buyer ships the goods before the fourteen-day period expires. The buyer bears the direct costs of returning the goods.

The buyer is only responsible for any loss in value of the goods if this loss is due to handling the goods in a way that was not necessary to examine their nature, characteristics, and functioning.

7. Cancellations

Returns of admission tickets and reservations made electronically are only accepted until 24:00 on the day before the event. After this deadline, there is no entitlement to a refund of the ticket price.

Cancellation of booked tickets is not possible. If the ticket is not used, it expires. Unused tickets cannot be exchanged at the ticket counter for a ticket on another date or returned. This applies in particular to the non-use of time-slot tickets due to late arrival at the entrance of the Deja Vu Museum. When expired tickets are returned for exchange for new ones, the customer is not entitled to immediate entry. The entry time for the new ticket will be recalculated by the system. Please note that each time-slot ticket loses its validity a maximum of 10 minutes after the calculated entry time if it has not been redeemed by then.

7.2 Group bookings for catering services and events
A cancellation by the customer is free of charge up to four weeks before the event. For cancellations up to three weeks before the event, the customer will be charged 30% of all services listed in the contract. For cancellations up to two weeks before the event, 50% of all listed services will be charged, and for cancellations up to one week before the event, 80% of all listed services will be charged.

The calculation basis is the number of people specified in the contract. The services charged to the customer must be paid to the account of Deja Vu Museum within 14 days without any deduction.

The customer reserves the right to prove that Deja Vu Museum GmbH has suffered no damage or significantly lower damage. The customer agrees that any deposits already paid can be offset against the applicable cancellation fees.

In cases of force majeure (fire, demonstrations, obstructions, etc.), events of a political or sectarian nature, or sales events where the content of the event has not been communicated to Deja Vu Museum GmbH, Deja Vu Museum GmbH reserves the right to cancel the order without notice. This also applies to events where there is a threat to Deja Vu Museum GmbH and/or its employees and/or guests. If the customer falls into arrears with payment to Deja Vu Museum GmbH more than once, Deja Vu Museum GmbH is entitled to withdraw from the contract with a notice period of 5 days or, alternatively, to demand immediate advance payment from the customer.

Tour cancellations

A cancellation by the customer is free of charge up to one week before the booked tour date. Otherwise, the full tour fee will be charged.

7.3 Group bookings
A group is defined as 20 or more people. A cancellation by the customer is free of charge up to one week before the booked visit date. Individual tickets for groups that have already been prepaid cannot be canceled.

8. Scope of Services and Obligations for Contracts Regarding Events

Die überlassenen Räumlichkeiten sind nach dem vereinbarten Ende der Veranstaltung unverzüglich zu räumen und im übernommenen Zustand zurückzugeben. Andernfalls behält sich die Deja Vu Museum GmbH vor, eine zusätzliche halbe Tagesmiete zu berechnen, sowie eventuelle weitere Restaurierungskosten in Rechnung zu stellen.

The setup and dismantling of exhibitions and similar events must be carried out by the customer and included in the event time. Storage of event materials is not possible. Deviating agreements must be arranged with the Deja Vu Museum visitor service and require confirmation. In any case, Deja Vu Museum GmbH excludes any liability for items or similar brought in and stored by the customer, unless the damage is due to grossly negligent or intentional breach of contract by the museum or its legal representatives or agents.

The customer must inform Deja Vu Museum GmbH in writing of the final number of participants and any changes to the scope of services no later than 72 hours before the start of the event. The number of participants provided at this point is binding, and reductions of up to 5% can be accommodated free of charge. Any further deviations are always at the customer’s expense.

The customer is liable for any damage or loss to facilities or inventory caused during an event. This does not apply if the damage or loss results from the responsibility of Deja Vu Museum GmbH.

Adhering posters to walls, driving nails, hooks, etc., into walls, ceilings, floors, or furnishings of Deja Vu Museum GmbH is not permitted. Any damage resulting from violations will be charged to the customer by Deja Vu Museum GmbH and must be paid by the customer.

Deja Vu Museum GmbH charges a corkage fee for serving drinks, etc., brought in by the customer. Any such arrangement requires the explicit agreement and permission of Deja Vu Museum GmbH for the customer to bring food and beverages.

If malfunctions or defects occur in the technical equipment provided by Deja Vu Museum GmbH, the museum will promptly remedy the situation. This does not entitle the customer to a reduction of the agreed room price. The customer’s warranty rights remain unaffected. If Deja Vu Museum GmbH procures technical or other equipment from third parties on behalf of the organizer, it acts in the name and on the account of the customer. The customer is responsible for careful handling and proper return of the equipment and indemnifies Deja Vu Museum GmbH against all claims from third parties arising from the provision of this equipment. Deja Vu Museum is obliged to inform the customer in a timely manner about holidays or days with limited operations.

Any necessary insurance for exhibition or decorative items brought in is the responsibility of the customer. Deja Vu Museum GmbH is liable for such items only according to the principles of gratuitous custody under § 690 BGB, meaning it is liable only for the care it exercises in its own affairs.

The customer is responsible for obtaining, at their own expense, any official permits and registrations required for the event. In particular, the customer is obliged to register with GEMA (Society for Musical Performing and Mechanical Reproduction Rights) for a fee and, in the case of a lottery or competition, to register with the competent lottery authority of the tax office. Any damage or similar consequences arising from the customer’s failure to do so are entirely the responsibility of the customer.

A request for changes on the day of the event regarding furniture, equipment, and seating can only be accommodated if an agreement on the associated costs has been reached. This also applies to catering provided by our respective partner.

Marked emergency exits must not be blocked or restricted. The staff of Deja Vu Museum GmbH are generally authorized to give instructions.

Any publications in which Deja Vu Museum GmbH is mentioned by name require prior consent and approval from Deja Vu Museum GmbH. If a publication is made without this consent, Deja Vu Museum GmbH reserves the right to cancel the event at short notice.

9. Liability / Compensation for Damages

Unless otherwise stated below, the customer’s claims for damages are excluded. If the customer asserts claims against the legal representatives and/or agents of Deja Vu Museum GmbH, the above disclaimer of liability also applies in their favor.

Exceptions to this are claims for damages arising from injury to life, body, or health, as well as claims for damages resulting from the breach of essential contractual obligations. Essential contractual obligations are those whose fulfillment is necessary to achieve the purpose of the contract.

Also excluded from the disclaimer of liability is liability for damages resulting from intentional or grossly negligent breaches of duty by the provider, its legal representatives, or agents.

The provisions of the Product Liability Act remain unaffected. Deja Vu Museum GmbH expressly advises all parents to supervise their children.

10. Warranties / Guarantees

The statutory rights regarding defects apply. Deja Vu Museum assumes no guarantee.

11. Access restrictions

The Deja Vu Museum asks for your understanding that all the items listed below may not be taken into the Deja Vu Museum, especially food, open drink containers, or glasses with liquids. The posted visitor regulations apply. Acceptance of the general terms and conditions also implies acceptance of the visitor regulations.

Entry to the Deja Vu Museum is prohibited for:

Food of any kind

Open drinks of any kind

Animals of any kind (except assistance dogs)

Skateboards, scooters, bicycles, inline skates, large suitcases, trolleys, backpacks, etc.

Weapons, hazardous materials (e.g., pressurized gas containers, glass bottles, fireworks, etc.)

In the event of violation, the admission ticket becomes void without compensation.

Smoking is strictly prohibited throughout the entire museum.

Children under 14 may enter the museum only when accompanied by an adult.

The admission ticket must be kept for the entire duration of the visit and must be presented upon request to the staff of Deja Vu Museum GmbH or security personnel. The ticket is also required to exit the museum. Persons without a valid admission ticket may be asked to leave the museum.

Deja Vu Museum GmbH reserves the right to close the museum at any time and without prior notice in case of imminent danger or for safety reasons. Tickets already purchased will be refunded in such cases. Reimbursement of travel expenses or similar costs is explicitly excluded.

12. Additional consumer information for distance contracts

The essential characteristics of the offered goods or services, as well as the validity period of limited-time offers, can be found by the customer in the respective product description.

Deja Vu Museum reserves the right to change the product range and the prices of the current assortment at any time. Any input errors during the order can be detected at the final confirmation before checkout and can be corrected at any time using the delete and edit functions before completing the purchase.

Deja Vu Museum GmbH is not subject to any special codes of conduct. The language available for concluding the contract is exclusively German.

13. Data Protection

Deja Vu Museum GmbH processes personal customer data in compliance with the data protection regulations applicable to the contract, as outlined in the Deja Vu Museum GmbH privacy policy. Data collection, processing, and use are carried out in an automated manner, insofar as this is necessary for the contractual relationship. The customer authorizes Deja Vu Museum GmbH to transmit this data to third parties commissioned with contract execution, as far as this is necessary to fulfill the concluded contracts, and in particular to permanently store all data about the visitor and the visit.

14. Prohibition of Assignment and Pledging

The assignment or pledging of claims or rights owed to the customer by Deja Vu Museum GmbH is excluded without the consent of Deja Vu Museum GmbH, unless the customer can demonstrate a legitimate interest in the assignment or pledging. This does not apply if the customer is a consumer.

15. Jurisdiction / Choice of Law

The place of jurisdiction for all disputes arising from the contractual relationship between the customer and Deja Vu Museum GmbH is the registered office of Deja Vu Museum GmbH, provided the customer is not a consumer. Applicable law is that of the Federal Republic of Germany. The mandatory consumer protection provisions of the country in which the customer has their habitual residence are excluded from the choice of law. The UN Convention on Contracts for the International Sale of Goods does not apply.

16. Place of Performance

If the customer is an entrepreneur, the place of performance for all disputes arising from this contract for both parties is Berlin, Germany.
